The Lawyers Disciplinary Responsibility

Abstract

In the current legislation, the lawyer is responsible for disciplinary breach of law or statute, for failure to binding decisions adopted by the governing bodies of the Bar or the Union, and for any act committed in connection with the profession or beyond, which are likely to prejudice honor and prestige of the institution or profession. In our country, the jurisdiction to investigate the violation and to exercise disciplinary action belongs, within the Law. 51/1995 to the Bar Council. In Romania, the disciplinary sanctions that can be applied to a lawyer guilty of committing a disciplinary offense are a reprimand; a warning; a fine from 50 lei up to 500 lei; the prohibition of exercising the job for a period of one month to one year and the exclusion of the profession.
