The Common Elements and the Differences Between the Pre-Emption Right and the Call Option

Abstract

Taking into consideration the various normative acts that settle the pre-emption right, we are going to present the following common and mandatory elements of this right, no matter the normative act in which it is settled. We also want to emphasize the main differences between the preemption right and the call option, since there are still authors who appreciate that the pre-emption right can be generated by the call option.
