Abstract

Good faith and fair dealing are required in the performance and enforcement of the contractual duties under a contract. This is the reason that gave birth to the idea of implementing these institutions of civil law in the so called European Civil Code. Despite of the fact that this idea is today only a project, it’s interesting to distinguish the differences of these institutions in the European systems of law.
