Abstract

The essay offers a general view upon the fundamental human right to a healthy environment. The healthy environment is an important issue in the present-day juridical literature and it also represents a very consistent goal of contemporary concerns. In 2003, it was for the first time when the Romanian legislator introduced in the Constitution a new fundamental human right – the right to a healthy environment. Still, the protection of the human right to a healthy environment can be also made by means of the sanctions included in the Criminal Law.
