Abstract

The claiming action is the action of the non-possessor owner against the non-owner possessor who requests the acknowledgement of his right and the restitution of the asset. Consequently the claiming action presents two aspects namely: the claimant solicits the acknowledgement of his proprietorship, which is contested by the defendant. As well as the restitution of the asset upon which he bears the proprietorship.
