Some comments on the offence of setting up an organized criminal group in Romanian legislation

Abstract

The study performs an analysis of the offence of setting up an organized criminal group, provided by Article 367 of the Romanian Criminal Code. When performing the analysis of the offence of setting up an organized criminal group, it was taken into account the text in force of the offence of setting up an organized criminal group provided by Article 367 of the Romanian Criminal Code, the provisions of Article 2 from the European Union Council Framework Decision 2008/841/JHA on the fight against organized crime and the provisions of the Article 5 from the United Nations Convention against Transnational Organized Crime.
