Dynamics of practical and legislative challenges for judicial cooperation in criminal matter

Abstract

In the area of freedom, security, and justice, the attention is aimed, as a qualitative orientation, towards the independence of the judicial systems and the effectiveness of fundamental rights. The article aims to analyze the legislative novelties in European law for judicial cooperation in criminal matters, as well as the status of their transposition in the national legislation, signaling at the same time the potential problems inherent in this process. Also, controversial aspects in judicial matters shall be revealed and a statistical analysis shall be carried out regarding the judicial cooperation in criminal matters within the jurisdiction of the Prosecutor’s Office attached to the Brasov Court of Appeal, for the period 2014 – 2017.
