Judicial Individualization of the Punishments for the Natural Person in the Romanian Law System

The judicial individualization of the punishments is the way in which the court of justice establishes and applies the punishment provided by law for the committed penal offense, taking into account the degree of social danger generated by the deed, the danger the individual represents, and the circumstances in which the action took place. The conditions that diminish or aggravate the corresponding punishment are called circumstances. This represents those situations, attributes, and extrinsic penal offenses that refer to the infringement of the law, on the author at to his personal estate.Published
