Abstract

When the legislator, no matter the democratic state he belongs to, tries to settle the freedom of expression, as a fundamental right recognised and guaranteed through juridical instruments in any state of law, he must take into consideration the necessity of protecting the reputation and dignity of a human being. Freedom of expression is guaranteed in any democratic society, but still there are some restraints to protect the right of a person to one’s own dignity, to honour, private life and the right to one’s own image.
