State Rights over Vacant Inheritances

Goods left by the defunct that have no legal or testamentary successors are transferred to the property of the state. The controversy regarding the quality in which the state collects an inheritance juridically unclaimed by the entitled ones de cujus as an inheritor or due to its virtue of sovereign power was stopped with the drafting of the project of the civil code. Due to the new settlements, the state’s vocation of succession, be it total or partial, operates in full right, the state not being thus an inheritor.Published
