Through the ratification of the European Convention of Human Rights in 1994, Romania committed itself to applying the case-law of this court, the European Court of Human Rights gaining compulsory jurisdiction regarding human rights and liberties in Romania. In this context, the application of the internal law regarding the detention of a person must comply with the stipulations of Article 5 of the European Convention of Human Rights.Published
