The Presumption of the Reciprocal Tacit Mandate between the Spouses

Abstract

This paper presents, explains, and thoroughly justifies Article 35 of the Civil Code, with respect to the administration and use of the spouses’ common property. A particular stress is laid on paragraph 2 of the above-mentioned article, which presumes the existence of a tacit mandate between the spouses with all its inherent consequences.
