The Restrain of the Right to Free Movement of Romanian Citizens Abroad

The right to free movement is a fundamental right of the citizen. Only with an exceptional title, the restraint in exercising some fundamental rights is possible by means of law, but this measure is proportional to the situation that determined it. This measure permits equilibrium between the citizens’ rights and the general interests of the society when the two are in conflict. The possibility of interfering with the legal text by means of rectification breaks this equilibrium and removes the spirit of the European Convention of Human Rights.Published
